Rule 507. Mandate to Issue


On the rendition of a final judgment or decree in the Supreme Court, the clerk of said court shall not issue and deliver the mandate of the court, nor certify the proceedings to the lower court, until all costs accruing in the case in the Supreme Court and the Court of Civil Appeals have been paid, subject to the provisions of the succeeding rule, and provided that when the trial court’s judgment is affirmed by the final decision of the Supreme Court, whether or not the same was affirmed by the Court of Civil Appeals, the party prevailing in the trial court and the Supreme Court may obtain a mandate without payment of any costs not taxed against him.
