Rule 468. Filing of Application for Writ of Error (1961)

TEXT

The application shall be filed with the clerk of the Court of Civil Appeals within thirty days after the overruling of the motion for rehearing, or within thirty days after the overruling of a final motion for rehearing if filed under Rule 458, provided that when the thirtieth day falls on Saturday, Sunday or a legal holiday the petition may be filed on the next day following which is neither a Saturday, Sunday nor a legal holiday.

If any party files an application within the time specified, any other party who was entitled to file such an application within such time but failed to do so shall have ten days additional time within which to file it.

Amended by order of July 26, 1960, eff. Jan. 1, 1961: Ten days additional time given party who would accept judgment but for filing of application by opposite party.
