Rule 363a. Amendment: New Appeal Bond or Deposit (1984)

TEXT

On motion to dismiss an appeal or writ of error for a defect of substance or form in any bond or deposit given as security for costs, the appellate court may allow the filing of a new bond or the making of a new deposit in the trial court on such terms as the appellate court may prescribe. A certified copy of the new bond or certificate of deposit shall be filed in the appellate court.

New rule.

Dec. 5, 1983, eff. April 1, 1984. It incorporates former Rule 430 with revisions. The references to the deposit for costs have been added, and the bond or deposit is to be filed or made in the trial court. Also, minor textual changes have been made.

Repealed by order of April 10, 1986, eff. Sept. 1, 1986.
