Rule 338. Certified Copy of Judgment (1962)

TEXT

A certified copy of the judgment of the district court when rendered shall forthwith be transmitted by the clerk of the district court to the clerk of the county court from which the case was appealed for the observance of such court. The county clerk shall record such certified copy of the judgment upon the minutes of the county court and note it upon the docket. The county judge shall make such order as may be necessary for the enforcement of such judgment.

Note: Rule 338 formerly dealt with joint ap­peals in guardianship proceedings. Its source was Art. 4321. Amended by order of April 12, 1962, eff. Sept. 1, 1962, Rules 332 to 339, inclusive, are rewritten and rearranged to establish uniform procedures applicable to appeals in both estate and guardianship proceedings. The provisions of Rule 338 are adapted from former Rule 335. Previous note regarding original Rule 338 has been deleted.
