Rule 191. When Citation Served by Publication (1971)

In suits where service of citation has been made by publication, and the defendant has not answered within the time prescribed by law, service of notice of deposition upon written questions may be made at any time after the day when the defendant is required to answer, by filing such notice and questions among the papers of the suit at least twenty days before such deposition is to be taken; service of notice may also be made in the manner prescribed in the preceding rule.

Amended by order of July 21, 1970, eff. Jan. 1, 1971: References to the commission and to filing interrogatories have been eliminated, and provision is made for filing the written questions with the notice among the papers of the suit.
