Electronic Discovery is becoming as routine in state court litigation as it already is in federal court litigation. What are the lawyer's duties with respect to counseling litigation clients about record/document preservation, and who is responsible if a reasonable "litigation hold" is not correctly and timely made and enforced? In today's litigation climate, what you tell or don't tell your client it must (not should) do about preserving documents – including most especially, ESI – regardless of whether you represent the plaintiff or the defendant, can ruin your day, your reputation, and your practice. In this interactive session of Just Ethics, Dana Andrew LeJune will alert and advise attendees about spoliation.
