Instructions:

For the first class on August 19, read the introductory material in 
Kunz & Chomsky, Contracts: A Contemporary Approach (2d ed. 
[be sure you have the 2nd ed.]) pp. 1-13.  Read also the 
first few pages on “consideration,” pp. 15-29.  This material 
includes two decisions in the case of Hamer v. Sidway.  You 
should brief each of these cases, as you should all of the cases you 
are assigned.  Note particularly the different approaches to 
consideration articulated by the two opinions.  Be prepared to 
discuss these differences.  It is obvious that the later opinion 
would control in New York at that time (as now).  Is that 
necessarily the better of the two approaches?  Why or why not?

For the second class on August 21, continue with consideration, pp. 
30-45.  What do we mean by the requirement of a “bargain?”
